Dear Ms. Young:
Immediately preceding my early retirement from SFWMD, I was the Permit Compliance Manager for the L-8 Reservoir Project (L8RP), owned and operated by the South Florida Water Management District (SFWMD) as a below-ground reservoir for flood control, water supply, and environmental restoration. Prior to that, I was the SFWMD Mercury Program Manager and the Inter-Agency Coordinator for the South Florida Mercury Science Program. Based on that experience and expertise, I would like to temporarily enjoin the operation of the L8RP until such time as the operator can provide reasonable assurance to the Florida Department of Environmental Protection (FDEP) and, more importantly, USEPA Region 4, that its operation will not adversely impact the human health, safety, and welfare, endangered species, the uses to which the downstream fresh, estuarine, and marine waters are or may be put, and/or U.S. EPA Region 4’s Clean Water Act (CWA) mercury Total Maximum Daily Load (TMDL) for the Loxahatchee River Estuary. I would also like to challenge the permit issuance process, the permit, and its implementation and enforcement on that same basis.
